By accessing or using the Service, you agree to be bound by these Terms & Conditions (the “Terms”). If you do not agree with these Terms, you should not use the Service.

2. Service Description

1. Nature of the Service
   • Passtastic is a platform for creating and distributing digital business cards. Users (“you” or “User(s)”) can customize cards with personal and business information (e.g., name, email, phone, address, website, logo, photo).
2. Key Features
   • Card Creation: Users can design and customize business cards, add custom information, logos, and photos.
   • Distribution: Each card has a QR code or link to facilitate sharing. Card recipients can add the card to their mobile wallet(Apple Wallet or Google Wallet).
   • Messaging: Card owners can send push notifications (updates, offers, promotions) to all card holders.
   • Analytics: The Service tracks how many messages are sent, how many cards have been installed, and how many are active in wallet apps.
   • Third-Party Integrations:
     • Analytics: Microsoft Clarity, Google Analytics
     • Email: SendGrid
     • Payment Processing: Stripe
3. Intended Audience
   • Our Service is designed for business professionals and corporate teams.

3. User Account Requirements

1. Registration Obligations
   • To create an account, you must provide a valid email address (or register via Google account) and basic profile information (e.g., name, business name, contact details).
   • By registering, you agree to (i) provide accurate, current, and complete information; (ii) maintain and promptly update your information to keep it accurate; and (iii) not abuse or misuse the platform.
2. Security Obligations
   • You are responsible for maintaining the confidentiality of your login credentials.
   • You must notify us immediately at [email protected] if you suspect any unauthorized use of your account.
   • You may not share your account with others, nor use someone else’s account without permission.
3. Termination of Accounts
   • You may delete your account at any time via your user settings or by contacting us.
   • We reserve the right to terminate or suspend your account if we determine you have violated these Terms, engaged in prohibited conduct, or for other legitimate reasons (e.g., legal compliance).

4. Acceptable Use & Content Guidelines

1. Prohibited Activities
   • You agree not to use the Service for any unlawful or prohibited purpose, including but not limited to:
     • Engaging in illegal activities, fraud, or deceptive practices
     • Spamming, harassing, threatening, or abusing other users
     • Attempting to hack, disrupt, or compromise the Service’s integrity or security
     • Uploading viruses or malicious code
     • Misrepresenting your identity or affiliation
     • Violating any applicable local, state, national, or international laws
2. User-Generated Content
   • You retain all rights to the content (logos, photos, text) you upload. However, by submitting content through the Service, you grant us a worldwide, non-exclusive license to use, display, reproduce, and distribute such content solely for the purpose of operating and improving the Service.
   • You are responsible for ensuring that your content does not infringe any third-party rights, and is not offensive, defamatory, or unlawful.
3. Moderation & Enforcement
   • We reserve the right, but have no obligation, to monitor and review user-generated content.
   • If we determine, in our sole discretion, that your content or activities violate these Terms, we may remove the offending content and/or terminate or suspend your account without prior notice.

5. Payment & Billing

1. Subscription Details
   • Our pricing and packages are described at Passtastic Pricing. We offer:
     • Free Package: No payment card required.
     • Growth & Business Packages: Includes a 30-day trial. After the trial, you’ll be charged according to your selected billing cycle (monthly or yearly). You may be required to provide payment card details upfront.
       • Pay-as-You-Grow Model: If you exceed card issuance/notification limits, additional fees will be charged automatically in accordance with the posted rates.
     • Unlimited Package: Offered under a custom arrangement.
   • By subscribing, you authorize us to charge the payment method you provided for any applicable subscription fees and overage costs.
2. Refund Policy
   • We do not offer refunds. The 30-day trial for Growth and Business packages allows you to evaluate the platform before being charged.
